How to spot a foreclosure scam

This industry attracts predators, and homeowners in foreclosure are the target. These rules apply to us as much as anyone else.

Walk away immediately if anyone:

  • Asks for money upfront. Charging a fee before mortgage relief is actually delivered is illegal under federal law.
  • Guarantees they'll stop your foreclosure. Nobody can promise that. Your lender decides.
  • Tells you to stop talking to your lender or to send your payments to them instead.
  • Wants you to sign over the deed or grant power of attorney to "hold" the property.

The questions we get every day

How much time do I actually have?
Once a Notice of Election and Demand is recorded, the public trustee sale is generally set about four months out, though it varies by county and sales are often continued. Colorado also gives you the right to cure the default — pay the arrears plus fees and costs — up to fifteen calendar days before the sale. The earlier you start, the more options are still open.
What does this cost me?
The options review is free, and Genesis Mortgage Relief charges homeowners nothing at any point. Federal law prohibits anyone from collecting a fee for mortgage relief before it's actually delivered, and we don't. If you choose to hire the independent attorney, any fee arrangement is between you and that attorney and gets disclosed to you in writing before you commit to anything.
Can you guarantee you'll stop my foreclosure?
No — and please don't believe anyone who says they can. Your lender decides whether to approve a modification, forbearance or repayment plan. What can be controlled is that your file is complete, submitted correctly, and in front of the right department before the deadline, and that you understand every alternative while there's still time to use one.
Should I stop paying, or stop talking to my lender?
No. Keep communicating with your servicer and keep paying whatever you can. Anyone who tells you to go silent on your lender, or to route payments to them instead, is breaking the law and putting your house at risk. We'll never tell you that.
Are you a law firm?
No. Genesis Mortgage Relief is a Colorado real estate company. Legal work is handled by an independent, licensed Colorado attorney we work with — you'd have your own direct relationship and engagement agreement with that attorney. We don't give legal advice.
What if I owe more than the house is worth?
Tell us anyway — it changes the strategy, not whether you have one. A lender-approved short sale or a deed in lieu may be on the table, and both generally land softer than a completed foreclosure. We'll be straight with you about which apply.
What if I just want to sell and be done?
That's a completely legitimate answer, and for a lot of people with equity it's the better one. We buy directly, in cash, as-is, and you pick the closing date. Colorado law also gives you the right to cancel a contract to sell a home in foreclosure, and that right is written into any agreement you'd sign with us.

How we make money — since we don't charge you

Genesis Estates LLC is a real estate investment company. We earn income from real estate transactions — including, in some cases, purchasing a property directly from an owner who decides on their own that selling is their best option. That is the entire business model, and it is why the options review costs you nothing.

We never charge homeowners a fee, and we never collect any payment before services are delivered. Most people who call us do not end up in a transaction with us at all, and that is a normal outcome we plan for.

You should know that, because it means we are not a neutral party. Ask us hard questions. We will tell you plainly when keeping the house, listing with a Realtor, or calling a free HUD-approved housing counselor is the better move for you — including when that means we make nothing.

The attorney is independent

Legal work is performed by a licensed Colorado attorney who is not employed by us. If you choose to engage them, that relationship and any fee arrangement is directly between you and that attorney, disclosed to you in writing beforehand.
